1. Who you're contracting with

These Terms & Conditions ("Terms") form a binding agreement between you and All My Paint ("All My Paint", "we", "us", "our"), the provider of the All My Paint service ("Service"). By creating an account, subscribing to a plan, or otherwise using the Service, you agree to these Terms.

2. The service

All My Paint lets you photograph paint cans and labels, extract details such as brand, color, formula, and store information, and search your paint inventory by room, brand, job, or date. Free, Pro, and Contractor plans have different storage limits, described on our pricing page.

3. Eligibility and accounts

You must be of legal age to enter into a binding contract in your country. If you use the Service on behalf of an organization, you confirm you have authority to bind that organization. You are responsible for keeping your login credentials confidential and for all activity under your account. Please keep your account information accurate and up to date.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• use the Service unlawfully or for fraudulent, spam, or abusive purposes;
• infringe intellectual property, privacy, or other rights of anyone;
• upload malware, probe, scan, or interfere with our security or infrastructure;
• scrape, mirror, or resell the Service or its content;
• reverse engineer or circumvent technical limits of the Service.

5. Your content

You keep ownership of the photos, notes, and other content you upload ("Your Content"). You grant All My Paint a limited, worldwide, non-exclusive license to host, process, and display Your Content solely to operate and improve the Service for you.

6. Our intellectual property

The Service, including the software, models, UI, branding, and documentation, is owned by All My Paint and protected by applicable laws. We grant you a limited, non-exclusive, non-transferable right to use the Service within your selected plan. All rights not expressly granted are reserved.

7. Payments, billing and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

Paid plans renew automatically each billing period until cancelled. You can cancel at any time from the pricing page or via the Paddle customer portal; access continues until the end of the current billing period. Prices are shown in USD and exclude any applicable taxes, which Paddle will calculate at checkout.

8. Refunds

Refunds are handled by Paddle in line with our Refund Policy.

9. Service availability

We work hard to keep the Service running smoothly, but we do not guarantee that it will be uninterrupted, error-free, or free from loss of data. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Suspension and termination

We may suspend or terminate your access if you materially breach these Terms, fail to pay, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service at any time by cancelling your subscription and, if you wish, deleting your account. On termination you may lose access to Your Content; please export anything you need beforehand.

11. Liability

To the fullest extent permitted by law, All My Paint's aggregate liability arising out of or in connection with the Service is limited to the fees you paid to Paddle for the Service in the twelve months before the event giving rise to the claim. We exclude liability for indirect, incidental, consequential, or special damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law, including for fraud, death, or personal injury caused by negligence.

12. Indemnity

You agree to indemnify All My Paint against claims arising from Your Content, your unlawful use of the Service, or your breach of these Terms.

13. Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be communicated in-app or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which All My Paint is established, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless a mandatory consumer-protection law requires otherwise.
